Abstract: The House Public Works Committee is re-encountering the controversial issue of using crumb rubber in pavements as it tries to advance a bill designating a new highway system. Section 1038 of the 1991 surface transportation law required states to use a certain percentage of scrap tire in pavement construction. States that did not comply could lose 20 percent of federal highway aid. Opponents of this section stress the need for further analysis of the long-term economic and health impacts of such a policy.
